Terms of Use

1. Purpose

These Terms of Use govern access to and use of the OTAKUN application, published by DEV DE BABI, based in Ivory Coast.

OTAKUN is a social app enabling users to create an account, publish content, interact with other users and access certain free or paid features.

2. Acceptance of terms

By creating an account or using the app, the user acknowledges having read and accepted these Terms of Use as well as the Privacy Policy.

3. App access and account creation

Using certain features requires creating an account through:

• Email and password
• Google account
• Apple account

Users agree to provide accurate, complete and up-to-date information.

Users are responsible for keeping their credentials confidential and for activities carried out through their account.

4. Minimum age

The app is reserved for users aged at least 13, subject to stricter rules that may apply in certain countries.

OTAKUN may suspend or delete any account that does not comply with this requirement.

5. Code of conduct

Users agree to use the app in a lawful, fair and respectful manner.

In particular, users must not:

• Publish or transmit illegal, hateful, violent, pornographic or shocking content, or content that infringes another person's dignity
• Harass, threaten or intimidate other users
• Impersonate another person
• Infringe third-party intellectual property rights
• Use the app for unauthorized fraudulent, abusive or commercial purposes
• Attempt to bypass platform rules, security mechanisms or technical systems

6. Moderation and sanctions

To ensure security, service quality and compliance with these Terms, OTAKUN may, in a proportionate manner:

• Delete or hide content
• Restrict specific features
• Temporarily suspend an account
• Permanently delete an account in case of serious or repeated violations

Where possible and appropriate, a less severe measure may be preferred before permanent account deletion.

Certain measures may be taken without prior notice in cases of urgency, security risk, legal obligation or manifest fraud.

7. User-posted content

Users remain the owners of content they publish on OTAKUN.

Users grant OTAKUN, for service purposes, a worldwide, free, non-exclusive license for the duration of publication of the content, allowing hosting, reproduction, display, technical adaptation and distribution within the framework of operating, promoting and improving the service.

Users warrant that they hold the rights required for the content they publish.

8. Paid features, subscriptions and digital content

The app may offer subscriptions, in-app purchases, as well as digital items or benefits.

Unless otherwise stated, digital content or benefits have no real monetary value, are not transferable and do not constitute proprietary rights in a patrimonial sense.

Pricing, duration, renewal and termination conditions are specified at the time of purchase or subscription.

9. Payments, cancellation and refunds

Purchases made via Google Play or the App Store are also subject to those platforms' rules and policies.

Payments made in the app are, in principle, final and non-refundable, except where required by applicable law, Google Play or App Store policies, or by an exceptional commercial decision of OTAKUN.

Subscription cancellation takes effect according to the payment platform conditions or those indicated at subscription time.

10. Account deletion

Users may request deletion of their account from within the application.

OTAKUN may also suspend or delete an account in case of breach of these Terms, fraud, security risk or legal obligation.

11. Service availability

OTAKUN strives to ensure access to the app under the best possible conditions.

However, the service may be suspended, limited or temporarily interrupted for maintenance, updates, technical incidents, security reasons or any other reason necessary for proper operation of the service.

12. Liability

Each user is responsible for the content they publish and their interactions with other users.

OTAKUNcannot be held liable for content published by users, other users' behavior, indirect damages or loss of opportunity, or temporary service interruptions beyond its control.

OTAKUN's liability cannot be excluded where applicable law prohibits such exclusion.

13. Intellectual property

The app, its name, visual identity, interfaces, design, texts, logos, graphic elements, databases and features are protected by intellectual property rules.

Without prior written authorization, any reproduction, exploitation or unauthorized use is prohibited.

14. Changes to these Terms

OTAKUN may modify these Terms at any time to reflect changes in the service, applicable regulation or offered features.

The applicable version is the one made available in the app or on the official publication medium.

16. Governing law and disputes

These Terms are governed by the law applicable at the publisher's registered office, subject to mandatory consumer protection rules that may apply depending on the user's country of residence.

In case of dispute, the parties will first seek an amicable solution before any legal proceedings.
